Our employment law team can assist you with:

  • Drafting and negotiating contracts of employment confidentiality clauses and restrictive covenants,
  • Providing advice on breach of employment contracts, wrongful dismissal, and actions for damages
  • Protecting confidential information, data protection, enforcing restrictive covenants, and seeking interdict and damages for breach of post termination covenants
  • Providing advice on how to manage an employee’s exit from a business acting either for companies or the executives on the terms of settlement agreements, avoiding reputational damage and maintaining confidentiality, the financial package and including or removing post termination restrictions.
  • Providing advice on disciplinary issues including investigations, suspension, framing allegations, conducting the hearing, drafting outcome findings, warnings, gross misconduct and grounds for summary dismissal, and the appeal process.
  • Providing advice on taking or dealing with a grievance, including the investigation, meeting drafting outcomes and the appeal process.
  • Restructuring, redundancy and consultation to avoid protective awards, but also advice on protective awards where there has been a breach of the consultation requirements.
  • Performance management and absence management, investigations, and consultations about fitness for work, disability discrimination including the duty to consider and make reasonable adjustments.
  • Pursuing and defending unfair dismissal claims (including a number of complex constructive dismissal claims), discrimination claims, wages claims, holiday pay claims (including agricultural wages claims), whistleblowing claims.
  • Drafting and advising on family friendly policies, maternity, paternity leave, parental leave and data protection policies, social media policies, disciplinary and grievance policies
